Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Korture platform operated by Korture Technologies LLP ("Korture," "we," "us," or "our"), accessible at https://korture.com and https://app.korture.com (collectively, the "Platform").

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you:

• Confirm you are at least 18 years of age
• Agree to comply with these Terms and all applicable laws
• Accept our Privacy Policy
• Consent to receive communications from us

2. Description of Service

Korture provides a talent assessment and team collaboration platform that:

• Administers psychometric assessments (RIASEC, JDR)
• Matches candidates to job roles based on scientific profiling
• Provides team health insights and collaboration tools
• Offers hiring and talent management solutions
• Generates interview guides and alignment reports

2.1 Early Access Program

The Platform is currently in early access. During this period:

• All features are provided free of charge
• Services may be modified, suspended, or discontinued without notice
• Features are subject to change based on user feedback
• No service-level agreements (SLAs) are guaranteed

3. Account Registration and Security

3.1 Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining account confidentiality
• You must notify us immediately of any unauthorized access
• One person may not create multiple accounts
• You may authenticate using email/password or OAuth (Google, LinkedIn)

3.2 Account Security

• You are responsible for all activities under your account
• We are not liable for losses due to unauthorized use of your credentials
• You must use strong passwords and enable two-factor authentication when available

3.3 Account Termination

We reserve the right to suspend or terminate accounts that:

• Violate these Terms
• Engage in fraudulent or abusive behavior
• Remain inactive for extended periods
• Pose security or legal risks

4. User Responsibilities and Conduct

4.1 Permitted Use

You may use the Platform to:

• Create and manage your professional profile
• Take psychometric assessments
• Apply for job roles
• Manage teams and hiring processes
• Access insights and reports

4.2 Prohibited Conduct

You may NOT:

• Use the Platform for illegal purposes
• Attempt to gain unauthorized access to systems
• Reverse engineer, decompile, or disassemble the Platform
• Scrape, data mine, or harvest user information
• Upload malicious code, viruses, or harmful content
• Impersonate others or misrepresent your identity
• Harass, abuse, or harm other users
• Share assessment content or proprietary methodologies
• Use the Platform to compete with Korture
• Circumvent payment systems or pricing mechanisms

5. Intellectual Property Rights

5.1 Korture's IP

All content, features, and functionality of the Platform, including:

• Assessment methodologies and algorithms
• User interface designs and branding
• Trademarks, logos, and service marks
• Software, code, and databases
• Reports, templates, and content

...are owned by Korture Technologies LLP and protected by Indian and international intellectual property laws.

5.2 User Content

• You retain ownership of content you submit (profile data, responses)
• You grant Korture a worldwide, non-exclusive, royalty-free license to use, process, and analyze your content to provide services
• You represent that you have rights to all content you submit
• Korture may use anonymized, aggregated data for research and product improvement

5.3 Feedback

Any feedback, suggestions, or ideas you provide become the property of Korture and may be used without compensation or attribution.

6. Pricing and Payment Terms

6.1 Pricing Structure (Post Early Access)

When billing begins, the following pricing will apply:

Hiring Services:

• First 3 aligned candidates per role: Free
• Additional aligned candidates: $99 per candidate (>70% alignment score)
• Charges occur when alignment threshold is reached

Team Health Services:

• First 3 team members: Free
• Team subscription: $249 per team per month (billed when 4+ members assessed)
• Ongoing access to team insights and collaboration tools

6.2 Payment Terms

• All prices are in USD unless otherwise specified
• Prices are subject to change with 30 days' notice
• Payment is required before service delivery (except during early access)
• We accept major credit cards and other payment methods as offered
• Billing events are tracked and displayed in your account

6.3 Refunds

• Refunds are provided at our discretion
• Services rendered are generally non-refundable
• Technical errors or service failures may qualify for refunds
• Contact team@korture.com for refund requests

6.4 Taxes

You are responsible for all applicable taxes, duties, and assessments. Prices do not include GST or other indirect taxes unless specified.

7. Assessment Data and Results

7.1 Assessment Validity

• Assessments are based on scientifically validated psychometric models
• Results are provided for informational purposes only
• Results should not be the sole basis for employment decisions
• Korture is not liable for decisions made based on assessment results

7.2 Data Accuracy

• You are responsible for providing accurate assessment responses
• Intentional manipulation of results violates these Terms
• We reserve the right to invalidate fraudulent or suspicious assessments

7.3 Result Sharing

• You control who can view your assessment results
• Hiring managers can view results of candidates who apply to their roles
• Team administrators can view results of team members
• Results are not shared publicly without your consent

8. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains:

• What data we collect and how we use it
• How we protect your information
• Your rights regarding your data
• Cookie and tracking practices

By using the Platform, you consent to data collection and use as described in our Privacy Policy.

9. Third-Party Services

9.1 Integration Services

The Platform integrates with third-party services including:

• Supabase (database and authentication)
• Google OAuth and Google services
• LinkedIn OAuth
• PostHog (analytics)
• Google Tag Manager, Google Analytics
• Google Ads, LinkedIn Ads, Meta Ads

9.2 Third-Party Terms

Your use of third-party services is subject to their respective terms and policies. Korture is not responsible for third-party services, their availability, or their practices.

10. Disclaimers and Limitations of Liability

10.1 Service "AS IS"

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for purpose
• Warranties of uninterrupted or error-free service
• Warranties regarding accuracy of results
• Warranties of data security

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Korture shall not be liable for indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the fees you paid in the 12 months preceding the claim
• We are not liable for losses due to force majeure, third-party actions, or your violations of these Terms

10.3 Employment Decisions

• Assessment results are tools to aid decision-making, not substitutes for professional judgment
• Employers are solely responsible for hiring decisions
• Korture is not liable for employment outcomes, discrimination claims, or wrongful termination

11. Indemnification

You agree to indemnify, defend, and hold harmless Korture Technologies LLP, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of third parties
• Your use or misuse of the Platform
• Your employment or hiring decisions based on assessment results

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or the Platform shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

12.3 Informal Resolution

Before filing a claim, you agree to contact us at team@korture.com to attempt informal resolution.

12.4 Arbitration (Optional)

Parties may mutually agree to resolve disputes through binding arbitration under the Arbitration and Conciliation Act, 1996.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting for non-material changes
• 30 days after notice for material changes

Notice of changes will be provided via:

• Email to your registered address
• Prominent notice on the Platform
• Updated "Last Updated" date

Continued use after changes constitutes acceptance. If you disagree with changes, you must stop using the Platform.

14. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any feature or service
• Change pricing with 30 days' notice
• Impose usage limits or restrictions
• Update technical requirements

We will make reasonable efforts to notify users of significant service changes.

15. Termination

15.1 Termination by You

You may terminate your account at any time by:

• Deleting your account through Platform settings
• Contacting team@korture.com
• Ceasing use of the Platform

15.2 Termination by Korture

We may terminate or suspend your access:

• Immediately for violations of these Terms
• Immediately for illegal or harmful conduct
• With 30 days' notice for convenience
• Immediately for security or legal reasons

15.3 Effect of Termination

Upon termination:

• Your right to use the Platform ceases immediately
• Your data will be retained or deleted per our Privacy Policy (90-day retention)
• Outstanding fees remain due and payable
• Provisions that should survive (IP, indemnification, limitation of liability) remain in effect

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Korture regarding the Platform.

16.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions remain in full effect.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

16.4 Assignment

You may not assign or transfer these Terms. Korture may assign these Terms without restriction.

16.5 Force Majeure

Korture is not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, wars, pandemics, government actions, internet outages, etc.).

16.6 Relationship

These Terms do not create a partnership, joint venture, employment, or agency relationship.
